Terms and Conditions

1. Overview

1.1 As a GiftCardExtras program member you will be bound by the following Terms and Conditions, as varied by us from time to time.

1.2 Members will be advised on our website of any variations when they come into force.

2. Meaning of words

2.1 In these Terms and Conditions the following words have the following meanings:

(a) Benefits means rewards and special offers available from participating businesses as offered from time to time in the form of Egift Cards subject to these terms and conditions as amended from time to time;

(b) GiftCardExtras program means those arrangements by which a member receives Benefits from participating businesses under these Terms and Conditions;

(c) Participating business means retailers (and other persons) who supply goods and services in respect of which various rewards, special offers and other benefits may be claimed by members subject to any conditions determined by those retailers;

(d) Registration form means the form completed by an individual (whether online or in paper form) to become a member of the GiftCardExtras program;

(e) We means Brewarded Pty Ltd (ABN 51818379240) ATF Home Ideas AdvantageCard Trust trading as GiftCardExtras or its authorised representatives located at Level 27, 101 Collins Street, Melbourne Vic 3000, phone 1300 552 946. Contact info@giftcardextras.com.

3. Membership

3.1 Only individuals (not corporations) may become members of the GiftCardExtras program.

3.2 We reserve the right to refuse any application for membership.

4. Using your membership

4.1 You may use your membership to receive the Benefits.

4.2 All Benefits are subject to availability and any conditions as determined by the relevant participating business. It is your responsibility to satisfy or comply with any conditions imposed by participating businesses for the receipt of any Benefits.

4.3 Each participating business providing Benefits identifies you as being eligible for the Benefit Online by way of an Egift Card in the following way:

(a) When you quote a promotional code if you are making a transaction by telephone, internet or mail order;

(b) When you click on a specific link to be directed to an external website where the benefit/ discount is accessible

c) When you print or display a benefit voucher on a mobile device and take it to the retail outlet of the relevant participating business

4.4 Benefits cannot be exchanged, transferred, sold, bartered, redeemed for cash or otherwise dealt with other than in accordance with these Terms and Conditions. If a Benefit voucher becomes lost or stolen it will not be replaced.

4.5 To the extent permitted by law we are not liable for any Benefit not being available for any reason whatsoever. In addition, and without limiting the foregoing, to the extent permitted by law we are not liable for:

(a) Any delay by or failure of a participating business to notify us of the details of a Benefit;

(b) A failure by you to take advantage of a Benefit because you have not complied with the participating business's conditions (including limited time offers) for receiving the Benefit; or

(c) Any failure by you to notify a participating business that you are a member and entitled to a Benefit.

4.6 Participating businesses may cease to be participants of the GiftCardExtras program from time to time. To the extent permitted by law we are not liable if you fail to receive a Benefit because a participating business ceases to be a participant in the GiftCardExtras program.

4.7 You must notify us immediately of any unauthorised transaction in relation to your membership.

4.8 You must notify us of any dispute relating to the Benefits as soon as possible after you become aware of the dispute. We will endeavour in good faith to resolve the dispute.

4.9 To the extent permitted by law we are not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.

5. Orders, Payment and Returns

5.1 All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

5.2 Expiration of Egift cards and vouchers may vary depending on the requirements of the participating business.

5.3 GiftCardExtras offers products for sale that are in stock and available for dispatch from our distribution centre. Occasionally however, we may be waiting for shipments from our suppliers. You will be notified of any delays due to low stock levels.

5.4 Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is an acceptance of your order.

5.5 We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a item or that the item ordered is out of stock.

5.6 If the issuer of your payment card refuses to authorise payment to GiftCardExtras, we will not be liable for any delay or non-delivery.

5.7 We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

5.8 Please note that we aim to dispatch all orders within 7 days. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. GiftCardExtras is not responsible for any delays caused by destination or handling delays.

5.9 All cinema vouchers sold by GiftCardExtras are restricted by the terms and conditions of each individual voucher type which can be found in the Terms & Conditions of the individual offers. All cinema vouchers are non-refundable and change will not be given irrespective of cinema pricing. Vouchers are valid until the expiry date indicated and cannot be exchanged or replaced. Ticket prices are subject to cinema pricing and may change without notice. Vouchers are sold for the personal use of GiftCardExtras members only. Vouchers are not to be re-sold and cannot be distributed.

5.9 Once an Egift card has been purchased by you and aid for it cannot be returned under any circumstances.

5.10 Egift Cards may purchased in Australia or internationally.

6. Termination of membership

6.1 We may terminate your membership if you, or a member of your immediate family:

(a) Fail to comply with these Terms and Conditions;

(b) Abuse any privilege accorded to you as a member under the GiftCardExtras program; or

(c) Supply any false or misleading information or make any false or misleading misrepresentations to us or to any participating business in connection with the GiftCardExtras program or a Benefit.

6.2 You may terminate your membership prior to the expiry of the 12 month term by giving written notice to us. On receiving such notice, we will note your member contact details on our database as inactive.

7. Changes, suspension or termination

7.1 From time to time, we may need to change these Terms and Conditions. If we reasonably believe that any amendment to these Terms and Conditions will benefit you or have a neutral impact on you, we can make the amendment(s) immediately.

7.2 Our Privacy Policy forms part of these Terms and Conditions, and will prevail over these Terms and Conditions if they are inconsistent in any respect. We will not purport to alter the Privacy Policy under sub-clause 7.1, without first giving written notice to members and giving members who do not wish to be bound by the changed Policy the opportunity to withdraw from the GiftCardExtras program.

7.3 To the extent permitted by law, we reserve the right to make any changes at any time without prior notice and in our absolute discretion to the Benefits.

7.4 Subject to applicable law, we reserve the right to suspend or terminate the GiftCardExtras program at any time without prior notice. To the extent permitted by law, we will not be liable for the suspension or termination of the GiftCardExtras program on any account whatsoever including (without limitation) for any Benefit that a member could have received at the time of suspension or termination.

8. Member information

8.1 Information about members, including information in the Registration form and information about receipt of Benefits by members will be held in our internal database ("our Database") which will contain information about you and your use of the membership.

8.2 We and our agents will only use the information from our Database to manage and administer the GiftCardExtras program.

8.3 Each member consents and agrees to the provision of the information on the Registration form to GiftCardExtras and authorises us to store and use that information, for the purposes stated in this clause 8.

9. Membership Renewal

An Annual Renewal Redemption Fee of 2,000 points is automatically deducted from Your Account on the anniversary of the Enrolment Date of Your Account unless You advise Brewarded in writing at least 30 days prior to the relevant anniversary of the Enrolment Date that You do not wish to renew the registration of Your Account.

10. Points Expiry

Points remain valid for a period of 2 years from the date that they are first credited to the Member’s Account, after which, if not redeemed, will be forfeited.

11. Liability

11.1 Subject to clause 9.4, all conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the GiftCardExtras program are expressly excluded to the full extent permitted by law. Any liability we may have to a member under statute in respect of such goods and services which cannot be excluded is limited, where permitted, to:

(a) Supplying, or paying the cost of supplying, the goods or services again; or

(b) Repairing, or paying the cost of repairing, the goods; at our option.

11.2 Subject to clauses 9.1 and 9.4, and to the extent permitted by law, any liability that we may have to a member whether for negligence, breach of contract or otherwise is limited:

(a) In the case of any claim relating to Benefits, to supplying, or paying the cost of supplying, the Benefit again or repairing, or paying the costs of repairing, the Benefit, at our option;

(b) In any other case to a maximum of $50.

11.3 Participating businesses do not have any authority, express or implied, to make any representation, warranty or statement on our behalf and we accept no liability in respect of such representations, warranties or statements.

11.4 Our services come with unconditional statutory warranties that they will be rendered with due care and skill and be reasonably fit for their purpose. You are entitled, at your option, to a refund, repair or replacement for a breach, and to compensation for any other loss. Any words in these words and conditions referring to "the extent permitted by law" and "subject to applicable law" are subject to these warranties.

12. General

10.1 A notice will be deemed to be given by us to a member if it is sent to the postal or email address of the member appearing in our Database as notified by you on the Registration form.

10.2 Any tax, liability or duty arising from a member's participation in the GiftCardExtras program is the responsibility of the member.

13. Third Party

13.1 We may include hyperlinks on this or to other websites or resources operated by parties other than GiftCardExtras, including advertisers and merchant partners. We have not reviewed all of the sites linked to the Site and is not responsible for the content or accuracy of any off-site pages, nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.
